PNC Files for Foreclosure on Banerjee

PNC Bank filed suit in Montgomery County Circuit Court on May 22 to foreclose on the principal residence of County Executive candidate Mithun Banerjee.¹ According to the filing, Banerjee defaulted on May 2, 2025, on a modified loan agreement, the second such extension PNC has granted. He owes the lender $290,876.

The PNC suit comes on the heels of a renewed foreclosure action on another of Banerjee's properties. Trustees for Shellpoint Mortgage Servicing say Banerjee defaulted on a $336,608 loan for his Briggs Court rental property in Silver Spring.² The case was stalled for months due to a bankruptcy stay. That stay was lifted earlier this year after the U.S. Court of Appeals for the Fourth Circuit upheld the dismissal of Banerjee’s Chapter 13 bankruptcy case, rejecting his appeals in two separate rulings issued November 3, 2025.³

With the bankruptcy shield gone, other creditors and lien holders are lining up to resume stalled cases and collect. In a matter unrelated to the foreclosures, PNC is seeking to recover $21,419 in credit card debt from Banerjee.⁴ LVNV Funding LLC is attempting to recover $1,209 in debt from a Credit One Bank card account.⁵ Attorneys for Bank of America are looking to collect on liens worth $6,667 after the bank was awarded attorneys' fees in a failed "infliction of emotional distress" lawsuit filed by Banerjee.⁶

Other parties to whom Banerjee owes money are slogging through appeals. Montgomery County is due $20,500 after Banerjee was found guilty for 41 housing code violations in December.⁷ After a judge dismissed his appeal fee waivers, Banerjee paid $410 to keep the appeal active. The mounting collection actions raise stark questions about his ability to retain ownership of the properties as these legal battles play out.

The Montgomery County primary election takes place June 23. Councilmembers Andrew Friedson, Evan Glass, and Will Jawando, as well as resident Peter James, are also seeking the Democratic nomination for County Executive.
